This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the mingledeals.com website and the Mingle Deals mobile application (collectively, the "Platform").

The Platform is owned and operated by MINGLE DEALS TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, with its registered office at K-307, Grand Ajnara Heritage, Sec-74, Noida, Uttar Pradesh, 201301, India (hereinafter referred to as "Mingle Deals", "we", "us" or "our").

For the purpose of these Terms and Conditions ("Terms"), wherever the context so requires, the terms "you", "your", "user", "visitor" shall mean any natural or legal person who has agreed to use and/or purchase from the Platform.

Your use of the Platform and/or purchase from us are governed by the following Terms and Conditions:

• The content of the pages of this Platform is subject to change without notice.
• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Platform for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
• Your use of any information or materials on the Platform and/or product pages is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through the Platform meet your specific requirements.
• Mingle Deals operates as a discovery and deals marketplace. The actual goods, services, food, spa, salon, wellness and event experiences are provided by independent third-party partner businesses ("Partners"). Vouchers, deals and offers purchased through the Platform are redeemable with the relevant Partner, subject to the terms, validity period and conditions stated on each deal. We are not the manufacturer or provider of the underlying goods or services and shall not be responsible for the quality, fitness or delivery of the same by the Partner.
• Each deal or voucher is subject to its own validity, usage limits, and redemption conditions as displayed at the time of purchase. It is your responsibility to review these before completing a purchase.
• The Platform contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms.
• All trademarks reproduced on the Platform which are not the property of, or licensed to, the operator are acknowledged on the Platform.
• Unauthorised use of information provided by us shall give rise to a claim for damages and/or be a criminal offence.
• From time to time, the Platform may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
• You may not create a link to the Platform from another website or document without MINGLE DEALS TECHNOLOGIES PRIVATE LIMITED's prior written consent.
• Any dispute arising out of the use of the Platform and/or purchase with us and/or any engagement with us is subject to the laws of India.
• We shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorisation for any transaction, on account of the cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Eligibility

You represent and warrant that you are at least 18 years of age and competent to enter into a legally binding agreement under the Indian Contract Act, 1872. By using the Platform, you agree to provide true, accurate and complete information during and after registration, and you are responsible for all activity that occurs under your account.

Pricing and payments

All prices for deals and vouchers are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Payments on the Platform are processed through our third-party payment gateway partner, Razorpay. By making a payment, you agree to the applicable terms of the payment gateway. We are not responsible for any issues arising at the payment gateway's end, including transaction declines or delays.

Refunds and cancellations

Purchases of deals and vouchers are final. Please refer to our Cancellation & Refund Policy for full details.

Limitation of liability

In no event shall Mingle Deals, its directors, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Platform or any deals purchased through it. Our total liability for any claim shall not exceed the amount paid by you for the specific deal or voucher giving rise to the claim.

Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts at Noida, Uttar Pradesh.
